Abstract

This talk will discuss hurdles placed on the EPA's ability to regulate for sustainable energy production after the Supreme Court decision of West Virginia v. EPA. It will first discuss the Clean Power Plan (at issue in the case) and the Court's approach to the EPA's method of using the Clean Air Act to create a generation-shifting approach towards energy production. Then it will discuss the Biden Administration's use of the Inflation Reduction Act to create incentives for sustainable energy production.
